Fourth meeting of the study group on German and Chinese law (July 3rd, 2007)

Mr. Prof. Dr. Xi, Director of the Center of Law and Economics at the Chinese University for Political Sciences and Law in Beijing, gave a presentation on the topic "The significance of European law in China"

On the 3rd of July, 2007, the study group organized its 4th meeting. For this session, Prof. Dr. Tao Xi, Director of the Center of Law and Economics at the Chinese University for Political Sciences and Law in Beijing consented to appear as guest speaker. Prof. Dr. Xi gave a presentation on the topic "The significance of European law in China". For the first time, the presentation was held in Chinese, while Mr. Xu, an assistant at the Chair for East Asian law, translated into German.

Prof. Xi has been a member of the National People's Congress of the People's Republic of China, which is the country's legislative body. In the course of his term, Prof. Xi, expert for the economic analysis of laws, dealt especially with the idea of estimated outcome analysis concerning legal proposals.

In his presentation, Prof. Xi first spoke about the model of estimated outcome analysis and its development in the European Union. After this, he explained the situation in China. Supporting his argument with many examples from his own experiences in working on bankruptcy law, property law, securities, and antitrust laws, he expressed his conviction of the high value of estimated outcome analysis. In the meantime, the State Council of the People's Republic of China has also begun working on this issue and has proposed the introduction of a cost-benefit analysis for laws. Specialists from the European Union have been invited to speak about their experiences. Recently, outcome analysis has been introduced on a trial basis in five provinces.

The topic of the presentation was met with great interest on the part of the participants in the study group. Therefore, a great many questions were asked, to which Prof. Xi gladly responded. As usual a cozy round at the Café Mehlwaage concluded the evening.
